If you reside in the United States and were mailed written notification by UST that your Private Information was potentially accessed, viewed, and/or obtained as a result of the Data Incident which occurred between July 25, 2025, and August 12, 2025, you may be a Class Member and eligible for Settlement Benefits. Excluded from the Settlement Class are: (i) the University of St. Thomas (“UST”), any Related Entities, and their officers and directors; (ii) all Settlement Class Members who timely and validly request exclusion from the Settlement Class; (iii) any judges assigned to this case and their staff and family; and (iv) any other Person found by a court of competent jurisdiction to be guilty under criminal law of initiating, causing, aiding or abetting the criminal activity occurrence of the Data Incident or who pleads nolo contendere to any such charge.

If you are a Class Member and wish to receive Settlement Benefits then you must submit a claim form by September 28, 2026.

The proposed Settlement will provide the following benefits to Settlement Class Members:

Credit Monitoring. Settlement Class Members can elect to enroll in three (3) years of one-bureau credit monitoring and identity theft protection services with at least $1,000,000.00 in identity theft insurance.

Documented Ordinary Losses (Out-of-Pocket Expenses). Settlement Class Members who incurred actual, documented out-of-pocket expenses due to the Data Incident, can get back up to $500.00. The losses must have occurred between July 25, 2025, and the September 28, 2026, and cannot have already been reimbursed by a third party. This benefit covers out-of-pocket expenses like:

  • professional fees including attorneys' fees, accountants' fees

  • fees for credit reports services

  • costs associated with freezing and unfreezing your credit with any credit reporting agency

  • credit monitoring costs that were incurred between July 25, 2025, and September 28, 2026

  • miscellaneous expenses such as notary, fax, postage, copying, mileage, and long-distance telephone charges

Documented Extraordinary Losses. Settlement Class Members who experienced actual, documented, and unreimbursed monetary losses stemming from identity theft or fraud, can get back up to $4,500.00. The losses must have occurred between July 25, 2025, and September 28, 2026, and cannot have already been reimbursed by a third party. You will need to show that:

  • the theft or fraud was probably caused by the Data Incident

  • the losses are not already covered by one or more of the other reimbursement categories

  • you made reasonable efforts to avoid, or seek reimbursement for, the loss, including but not limited to exhaustion of all available credit monitoring insurance and identity theft insurance

Losses related to Sensitive Personal Information. Settlement Class Members who experienced a disclosure of their Sensitive Personal Information can claim a $100.00 cash payment. Some examples of Sensitive Personal Information include:

  • employment files and records

  • reports of professional or criminal misconduct

  • settlement agreement

  • other information related to legal proceedings

  • disciplinary records

If you are claiming for Documented Ordinary Losses, Documented Extraordinary Losses and/or Losses related to Sensitive Personal Information, you need to submit proof, like receipts, to show how much you spent or lost. You can also provide notes or papers you made yourself to explain or support other proof, but those notes or papers alone are not enough to make a valid claim. Your proof or notes should show that your expenses were because of the Data Incident.

Alternative Cash Payment. In lieu of submitting a claim for any other benefit as described above, Settlement Class Members may submit a claim for an Alternative Cash Payment of $50.00.

The deadline to submit a Claim Form online is September 28, 2026. If you are mailing your Claim Form, it must be mailed with a postmark date no later than September 28, 2026.
